Terms and Conditions
1. About These Terms
These Terms and Conditions govern the enrolment of students onto DPTA courses and classes via our Class Manager system, and the ongoing relationship between DPTA and the parent, guardian, or adult student ("you") who registers. By creating a Class Manager account or enrolling a student, you agree to these Terms.
2. Enrolment and Registration
2.1 Enrolment is completed through Class Manager and is confirmed once full payment has been received and you have received written confirmation from DPTA.
2.2 You must provide accurate and up-to-date information for each student, including emergency contact details, relevant medical information, and any additional needs, and keep this updated via your Class Manager account.
2.3 Places are offered subject to availability. DPTA reserves the right to decline or withdraw an enrolment at its discretion, including where a class is full, unsuitable for the student's age/ability, or where fees remain unpaid.
2.4 Enrolment is ongoing on a term-by-term basis. Once enrolled, a student's place is assumed to continue automatically into the following term unless you notify DPTA otherwise in accordance with Section 4.
2.5 Trial classes: each child is entitled to one free trial class per course/session before committing to a term. Trial classes are subject to availability, do not require advance payment, and carry no obligation to continue. All other provisions of these Terms (including Sections 6, 7 and 8) apply to trial classes.
2.6 By making payment via Class Manager, you confirm that you have read, understood, and agree to be bound by these Terms.
3. Fees and Payment
3.1 Course fees are as set out in Class Manager at the time of booking and are billed term by term.
3.2 Fees are payable in full in advance of the start of each term.
3.3 Sibling discount: where more than one child from the same family is enrolled, each enrolled sibling receives a 5% discount on their course fee.
3.4 Students joining part-way through a term will be billed on a pro-rata basis, calculated from their start date to the end of that term.
3.5 DPTA is not VAT-registered, so no VAT is charged on fees.
3.6 Late or unpaid fees may result in the student's place being suspended.
3.7 DPTA reserves the right to change fees for future terms, with reasonable notice given via Class Manager or email.
4. Cancellations and Refunds
4.1 Cancellation by you: to cancel a student's place for an upcoming term, written notice must be given via Class Manager or email at least 30 days before the start of that term. Cancellations received with less than 30 days' notice, or after the term has started, are not eligible for a refund.
4.2 Once a term has started, fees are non-refundable, including where a student misses one or more sessions.
4.3 Cancellation of a single session by DPTA: if DPTA needs to cancel an individual scheduled class for any reason, no refund will be issued for that session; instead it will be rescheduled and added to the end of the term.
4.4 Cancellation of a whole term by DPTA: if DPTA cancels an entire term of a course, a full refund will be given for that term.
5. Attendance and Missed Classes
5.1 Fees are payable regardless of attendance, except where a class is rescheduled or a term is cancelled by DPTA under Section 4.
5.2 Please notify DPTA in advance of any expected absence via Class Manager.
5.3 DPTA reserves the right to remove a student from a course for persistent unexplained non-attendance.
6. Health, Safety and Code of Conduct
6.1 Parents/guardians must disclose any medical conditions, allergies, or additional needs that may affect a student's participation.
6.2 Students and parents/guardians are expected to behave respectfully towards tutors, staff, and other students. DPTA reserves the right to suspend or remove a student whose behaviour, or that of their parent/guardian, is disruptive, unsafe, or abusive towards others.
6.3 DPTA will take reasonable care of students during sessions but cannot be held responsible for injury or loss except where caused by our negligence (see Section 10).
7. Safeguarding and Child Protection
7.1 DPTA is committed to safeguarding the welfare of all children and young people in its care and operates in line with our Safeguarding Policy and The Children (Performances and Activities) (England) Regulations 2014, a copy of which is available on request.
7.2 All staff, volunteers, and chaperones working with children undergo an enhanced DBS check and receive training on child protection and safeguarding procedures.
7.3 A designated Safeguarding Lead oversees child protection matters and is the main point of contact for any concerns.
7.4 Children will only be released to a designated parent/carer at the end of a session unless prior arrangements have been agreed in writing.
7.5 Any safeguarding concerns will be handled in accordance with our Safeguarding Policy and, where necessary, reported to the Local Authority Designated Officer (LADO) or Social Services.
8. Photography, Filming and Media Consent
8.1 DPTA may take photographs or video during classes, rehearsals, and performances for promotional use (website, social media, marketing materials) and for internal records.
8.2 Consent for use of images/video of your child is collected separately during registration via Class Manager and can be withdrawn at any time by contacting DPTA.
8.3 Parents/guardians attending performances are asked not to publicly share images of other people's children without consent.
9. Force Majeure
9.1 DPTA will not be liable for any failure or delay in delivering a class or session caused by circumstances beyond its reasonable control, including but not limited to severe weather, venue unavailability, national emergency, pandemic, or staff illness affecting the whole class.
9.2 Where a session is affected by such circumstances, DPTA will reschedule it where reasonably possible, in line with Section 4.3. Where an entire term is substantially disrupted, the refund policy at Section 4.4 will apply.
10. Liability and Insurance
10.1 DPTA holds public liability insurance.
10.2 Nothing in these Terms limits or excludes DPTA's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10.3 Subject to 10.2, DPTA's liability for any loss arising from these Terms is limited to the fees paid for the relevant term.
11. Data Protection and Your Class Manager Account
11.1 DPTA processes personal data (including student and parent/guardian details) in accordance with UK GDPR and the Data Protection Act 2018. See our Privacy Policy for full details.
11.2 You are responsible for keeping your Class Manager login credentials secure and for the accuracy of information held in your account.
11.3 Data collected via Class Manager is used solely for administering enrolments, communications, safeguarding, and payment processing, and is not shared with third parties except as necessary to operate the service (e.g. payment processors) or as required by law.
12. Complaints
12.1 If you are unhappy with any aspect of DPTA's service, please put your complaint in writing to damien@dpta.co.uk.
12.2 DPTA will acknowledge your complaint and aim to investigate and respond within a reasonable time.
13. Changes to These Terms
DPTA may update these Terms from time to time. Continued use of Class Manager or enrolment in future terms constitutes acceptance of the updated Terms, which will be made available via Class Manager.
14. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
